Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: The period within which the consumer may exercise their right of withdrawal.

  • Consumer: The natural person not acting in the exercise of a profession or business who enters into a distance agreement with the entrepreneur.

  • Day: Calendar day.

  • Duration transaction: A distance agreement related to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.

  • Durable medium: Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows for future consultation and unaltered reproduction of the stored information.

  • Right of withdrawal: The option for the consumer to waive the distance agreement within the cooling-off period.

  • Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance.

  • Distance agreement: An agreement whereby, within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement.

  • Technique for distance communication: A means that can be used to conclude an agreement without the consumer and entrepreneur being in the same room at the same time.

  • Terms and Conditions: These present General Terms and Conditions of the entrepreneur.

Article 2 – Applicability

These terms and conditions apply to every offer from the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the agreement is concluded that the terms and conditions can be inspected at the entrepreneur's premises and will be sent free of charge as soon as possible upon the consumer's request.

If the distance agreement is concluded electronically, the text of these terms and conditions may be made available to the consumer electronically in such a way that it can be easily stored on a durable medium. If this is not reasonably possible, it will be indicated where the terms can be viewed electronically before the agreement is concluded.

If specific product or service conditions also apply, the second and third paragraphs apply accordingly, and in the event of conflicting terms, the consumer may always rely on the applicable provision that is most favorable to them.

Article 3 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be expressly stated.

The offer is non-binding. The entrepreneur is entitled to change and adjust the offer.

The offer contains a complete and accurate description of the products and/or services. The description is detailed enough to allow the consumer to make a proper assessment. If images are used, they are a true representation. Obvious mistakes or errors in the offer do not bind the entrepreneur.

All images and specifications in the offer are indicative and cannot lead to compensation or dissolution of the agreement.

The entrepreneur cannot guarantee that the displayed colors exactly match the real colors of the products.

Each offer contains information that makes it clear to the consumer what their rights and obligations are, specifically:

  • The price, excluding customs clearance fees and import VAT. These additional costs are at the customer's expense and risk.

  • Any shipping costs.

  • How the agreement will be concluded.

  • Whether the right of withdrawal applies.

  • The method of payment, delivery, and execution.

  • The period for acceptance of the offer.

Article 4 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the set conditions.

The entrepreneur will immediately confirm receipt of the acceptance of the offer electronically. As long as this receipt has not been confirmed, the consumer may dissolve the agreement.

The entrepreneur takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment.

Article 5 – Right of Withdrawal

When purchasing products, the consumer has the option to dissolve the agreement without giving reasons for 30 days. This period starts the day after receipt of the product.

During this period, the consumer must handle the product and packaging with care. They shall only unpack or use the product to the extent necessary to decide if they wish to keep it.

To exercise this right, the consumer must notify the entrepreneur in writing/email within 30 days. After notification, the customer has another 30 days to return the product.

Article 6 – Costs in Case of Withdrawal

If the consumer exercises their right of withdrawal, the costs of returning the products are at the consumer’s expense.

The entrepreneur will refund the amount as soon as possible, but no later than 30 days after the withdrawal, provided the product has been received back or conclusive proof of return is provided.

Article 7 – Exclusion of the Right of Withdrawal

The entrepreneur can exclude the right of withdrawal for certain products, such as:

  • Custom-made or personalized products.

  • Perishable goods.

  • Hygiene products where the seal has been broken.

  • Sealed audio/video recordings or software where the seal is broken.

Article 8 – The Price

Prices will not be increased during the validity period stated in the offer, except for changes in VAT rates.

As the place of delivery is outside the EU (per Article 5, paragraph 1 of the VAT Act 1968), the courier will collect import VAT and/or customs fees from the recipient. Therefore, the entrepreneur will not charge VAT.

Article 10 – Conformity and Warranty

The entrepreneur warrants that the products meet the agreement and reasonable requirements of reliability and usability.

Any defects or incorrectly delivered products must be reported to the entrepreneur in writing within 30 days of delivery. Returns must be in original packaging and new condition.

Article 11 – Delivery and Execution

The entrepreneur will exercise the greatest possible care when receiving and executing orders. The delivery address is the address provided by the consumer.

Orders will be executed within 30 days unless a longer period is agreed upon. If delivery is delayed, the consumer has the right to dissolve the agreement free of charge.

Article 12 – Duration Transactions

Consumers can terminate an indefinite agreement for regular delivery of products at any time, subject to agreed termination rules and a notice period of no more than one month.

Article 13 – Payment

Unless otherwise agreed, amounts owed by the consumer must be paid within 7 business days after the start of the cooling-off period.

Article 14 – Complaints Procedure

Complaints about the execution of the agreement must be submitted fully and clearly described to the entrepreneur within 7 days after the consumer has discovered the defects.

Article 15 – Disputes

Agreements between the entrepreneur and the consumer are exclusively governed by Dutch law, even if the consumer resides abroad.

Article 16 – CESOP

Due to measures introduced in 2024 regarding the "Amendment of the Turnover Tax Act 1968," payment service providers may record data in the European CESOP system for payment information.

FAQ

order management

Orders may be cancelled within 2 hours of placement, provided they have not yet been processed or dispatched. To request a cancellation within this timeframe, please contact us at info@lucyandporter.com.

After the 2-hour cancellation window has passed, or once the order has entered processing, cancellations can no longer be accommodated, as preparation for shipment will already be underway.

Shipping and Delivery

Lost Packages

At Clara & Finn, we are committed to ensuring that your order arrives safely and in excellent condition. If your package is lost during transit, please reach out to our customer support team at info@Clarafinn-seattle.com with your order number and any relevant details so we can investigate and assist you promptly.

Damaged Packages

We understand how disappointing it can be to receive a damaged parcel. If this occurs, please contact us within 5 days of receiving your order at info@Clarafinn-seattle.com and include clear photos of the damaged item(s) and packaging.

After reviewing the information provided, we will determine the appropriate resolution, which may include sending a replacement or issuing a refund.

Once your order has been processed, you will receive a confirmation email containing your order details and tracking number.

You may use the tracking number to monitor your shipment’s progress. Please note that tracking updates may take up to 48 hours to appear in the carrier’s system. If no update is visible immediately, kindly check again later.

Our standard delivery timeframe within the USA is 5–7 business days.

Shipping costs are calculated at checkout and displayed before you complete your purchase. Delivery times may vary depending on your location and seasonal demand.

We currently do not offer international shipping, but we are working toward providing this option in the future.

Refunds and Exchanger

Returns
To initiate a return, please contact our customer support team at info@Clarafinn-seattle.com with your order number and details of the item(s) you wish to return.

Please note:
- We do not provide return labels or return slips.
- Customers are responsible for return shipping costs in accordance with our Return Policy.

Refund Process
Once the returned item is received, it will be inspected to ensure it meets the requirements outlined in our Return Policy. If approved, the refund will be issued to the original payment method.

Non-Returnable Items
Certain items are not eligible for return due to hygiene reasons, final sale status, or other specified conditions. These exclusions are clearly indicated on the respective product pages.

We offer refunds and exchanges within 30 days of delivery.

To qualify, items must be returned in their original condition, including all tags and original packaging. Please note that sale and refurbished items are not eligible for refunds or exchanges.
